(Clothier and outdoor gear retailer L.L. Bean has sued four companies, Nordstrom, J.C. Penney, Atkins, and Gevalia, for serving pop-up advertisements that appeared when users accessed L.L. Bean's website, infringing on L.L. Bean's trademark. The four companies had contracted with Claria Corporation, an adware company that tracks users' online habits, and serves tailored pop-up ads. L.L. Bean vice-president for e-commerce Mary Lou Kelley notes that consumers often download adwares and other spywares unknowingly, then become annoyed at pop-up ads, damaging L.L. Bean's customer relations.)
